What does it mean to register?

The term register refers to the act of registering in the municipal register. An administrative record that contains the data of all the residents who live or habitually reside in the town.

Is it mandatory to register in a rental apartment?

According to the Official State Gazette, BOE, it is an essential requirement to register in the register. It is considered both a right and a duty.

“Everyone who lives in Spain is obliged to register in the Municipal Register of the municipality in which they habitually reside. Whoever lives in several municipalities, or in several addresses within the same municipality, must register only in the one that lives for the longest time per year.”

(BOE-A-2020-4784, Section 1.2)

Requirements to register in a rental flat

To carry out the registration, the following documents must be presented:

  • Lease agreement (original and photocopy).
  • Inscription sheet.
  • DNI, passport or residence card (original and photocopy). If there are several members in the same family unit, each one must present copies of their ID or the family book.

Of course, the rental contract must be in force and have a minimum duration of six months. In the case of having a smaller extension and with the aim of demonstrating the intention to reside in the property in the long term, it will be necessary to present an extension previously agreed and signed with the owner.

Despite the fact that registering is mandatory, many citizens choose not to do so when they change their residence.

However, only in this way is it possible to access a series of benefits in the area where the home has been rented. As which?

  • Request and renew the ID and passport.
  • Update driving license.
  • Ask for social help.
  • Claim places in schools.
  • Register a vehicle.
  • Access healthcare.
  • Carry out procedures in the Civil Registry.
  • Exercise the right to vote.

If you do not register, each time you want to carry out any of these actions, you will have to return to the municipality where you are registered.
